A westside Chicago school, Little Village Academy, has banned schoolchildren from bringing their own lunches from home. They now require all students to purchase their meals from the school cafeteria. An age-old American tradition has fallen by the wayside in Illinois.

Libertarian Republican radio talk show host Neal Boortz comments,

“So there you go folks … government knows best. If you surrender your child to the government to be educated, they you surrender your right to determine what type of lunch that child will eat. While the government has physical possession of your child in their indoctrination centers your rights are essentially terminated.

“There are two messages at work here. One is that parents have to come to the understand that parents don’t know nearly as much about how to raise their children as the government does. The second message is delivered to the children — and that message is that now is as good a time as any for you to learn that the government is going to be involved in virtually every aspect of your life — even down to what you are allowed to eat for lunch.”

Michigan State Police Extracting Data from Driver Cell Phones

The Michigan State Police have a high-tech mobile forensics device that can be used to extract information from cell phones belonging to motorists stopped for minor traffic violations, according to TheNewspaper.com, a journal of the politics of driving.

If you’re pulled over by the Michigan State Police for anything — an improper turn, a partially obscured license plate, or an officer’s whim — they can search your cell phone using a device called the CelleBrite UFED. That means text messages, photos, videos, contacts, who you’ve called, what apps you’ve downloaded, GPS data that reveals where you’ve been, even deleted data.

The American Civil Liberties Union (ACLU) learned that the police had acquired the cell phone scanning devices and in August 2008 filed an official request for records on the program, including logs of how the devices were used. The state police responded by saying they would provide the information only in return for a payment of $544,680.

“The Michigan State Police should be willing to assuage concerns that these powerful extraction devices are being used illegally by honoring our requests for cooperation and disclosure,” said ACLU attorney Mark P. Fancher. The ACLU is concerned that these powerful capabilities are being quietly used to bypass Fourth Amendment protections against unreasonable searches. We have that same concern.

A U.S. Department of Justice test of the CelleBrite UFED used by Michigan police found the device could grab all of the photos and video off of an iPhone within one-and-a-half minutes. The device works with 3000 different phone models and can even defeat password protections.

Nevada’s Libertarian Streak on Seatbelts and Helmet Laws

“Two big victories against the Nanny-State in Nevada this week. The State Senate Transportation committee voted against tougher enforcement for seat belt non-usage, and for legalizing motorcycle use without a helmet. Predictably, all Republicans sided with the pro-freedom side. And virtually all Democrats voted against freedom.

From the Las Vegas Sun, “Senate committee says no to helmets, tougher seat belt law,” April 14:

“The seat belt bill would allow police to stop a motorist and issue a citation solely for not wearing a seat belt. The present law allows officers to issue a citation only if the driver is stopped for another traffic infraction. Sen. Elizabeth Halseth, R-Las Vegas, who opposed the bill, SB 235, said Nevadans use safety belts at a higher rate than neighboring states.

Sen. Mike Schneider, D-Las Vegas, in arguing for the bill, said the buckle-up rate is only 30 percent at night. The 93 percent figure cited is falsified to get federal funds, he charged. He said opponents of the bill argue not wearing a seat belt is a personal choice, but everyone ends up paying to treat those injured because they aren’t buckled up. Voting against the bill were Halseth, Dean Rhoads, R-Elko, Mike McGinness, R-Fallon, and John Lee, D-North Las Vegas.

On the helmet law:

“The helmet bill, SB 177, removes the helmet requirement for motorcycle drivers and passengers if they are at least 21 years old and the driver has held a license for a year or more and completed a safety course. Halseth said whether to wear a helmet should be a personal choice. She said figures from University Medical Center show riders injured while not wearing a helmet actually cost less to treat than those hurt while wearing helmets.

Schneider, however, said everyone bears the cost. “This is costing society millions of dollars. No way does this benefit the state of Nevada,” he said. Manendo, Schneider and committee Chairwoman Shirley Breeden, D-Las Vegas, voted against the bill.

Illinois Moves to Ban Trans Fats

The Pat Quinn/Rahm Emanuel/Dick Durbin/Rod Blagojevich/Barack Obama State strikes again.

Note the blatant editorializing in this “news report” by the Gate House New Service out of Springfield, Illinois (via GalvaNews.com): “Illinois House moves to ban trans fat in foods”:

“Illinois is poised to become the second state in the country (after California) to ban artery-clogging artificial trans fats. The Illinois House last week approved a bill to eliminate artificial trans fats from restaurant and bakery food and food sold in school vending machines by January 2013. Cafeterias operated by state and local governments and schools would not be included in the ban until January 2016.

“Trans fats are like bacon grease pouring down your sink clogging your pipes,” said Rep. La Shawn Ford, D-Chicago, sponsor of House Bill 1600. “That’s exactly what trans fats do to your arteries. You can still have fried foods and baked goods without trans fats.”

Republicans and one brave rural Democrat are the only ones standing against this nanny-state imposition on individual liberties: “It’s yet another nanny-state mandate on the public when the businesses and communities are perfectly capable of making these decisions themselves,” said Rep. David Leitch, R-Peoria.

“We don’t have to be a watchdog for everyone,” argued Rep. Frank Mautino, D-Spring Valley. “We tell people to do a lot of things, and it would probably be good if they did them, but maybe at some point they’d like to decide on their own if they should do them or not.”

Mr. Costin serves a board member of Northwest Suburban Taxpayers United and a volunteer with the Citizen Police Academy Alumni Association of Schaumburg. Brian serves as Director of Outreach for the Illinois Policy Institute. Among his duties is heading up the Liberty Leaders project. Previously, he worked for the Heartland Institute as Assistant Director of Government Relations.

In 2008, Brian founded the Schaumburg Freedom Coalition, a non-partisan, non-profit volunteer group advocating lower taxes, personal and economic freedom, and greater government transparency. SFC gained recognition for its work in exposing the Village of Schaumburg’s red light camera program as a failed safety measure and preventing an unjust $15 million tax.

Schaumburg hasn’t seen a fight for mayor since 1995. Brian’s 2011 campaign is focusing on ethics reform, disciplined spending, and lower taxes for village residents. The election will occur on April 5.

But with less than two weeks until the 2010 mid-term elections, the Midwest has become the President’s biggest problem area.

The President’s party is poised to lose at least four Senate races in the Midwest (IN, MO, ND, OH) while two others remain tight contests in which the GOP candidate has been consistently leading (IL, WI). Of the four open Midwest gubernatorial contests, the GOP is posting solid results in three of them (IL, OH, WI) with another, Minnesota, still up for grabs.

Looking at swing Congressional races is where you really get an idea of the Democrats’ Midwestern problem. States that rarely have competitive races like Minnesota and Missouri each have several vulnerable incumbents in 2010. Missouri Blue Dog Democrat incumbent Ike Skelton, who has represented central-west Missouri for more than 30 years, is facing perhaps his toughest challenge yet. A similar situation is facing U.S. Rep. Jim Oberstar, who represents northeast Minnesota. Oberstar has been in Congress consistently for nearly 40 years and is in the race of his life. Tim Walz, a second term Democrat from a southern Minnesota swing district, is facing a tough reelection battle as well.

Wisconsin — which is thought to be liberal but is more accurately categorized as a swing state — currently has only three Republicans in its eight member Congressional delegation but may have just two Democrats in its delegation by January, 2011. Vulnerable incumbents there include Reps. Steve Kagen (D) in the northeastern part of the state and Ron Kind (D) in the west.

Illinois and Ohio have between five and six seats each that are extremely competitive House races while four Michigan and three Iowa and Wisconsin seats are up in the air.

Illinois’ western-most district, represented by second term Congressman Phil Hare, was a seat pundits never thought would be in play. But the rural, gerrymandered district is now a national target of Republicans, who have an excellent candidate in businessman Bobby Schilling. Mark Kirk’s vacated seat in the moderate northern Chicago burbs is also up for grabs and is really the Democrat’s only pickup opportunity in the Midwest this cycle. Reps. Melissa Bean (D) in the western Chicago suburbs, Bill Foster (D) in the southern Chicago suburbs, and Debbie Halvorson (D) in central Illinois are also in tough reelection battles. Halvorson, who doesn’t shy away from any of her votes or support of the Obama agenda, has been down as far as eighteen points in recent surveys.

In Iowa, all three of the incumbent Democrat Congressmen, Reps. Bruce Braley, Dave Loebsack, and Leonard Boswell could lose. Indiana’s Joe Donnelly (D) and Baron Hill (D) are facing tough challenges and Brad Ellsworth’s open seat in southern Indiana is poised for a Republican pickup.

The upper Midwest is heavily in play, too. Bart Stupak’s open Michigan upper Peninsula seat is leaning Republican, as are the two northern Wisconsin seats held by the retiring Rep. David Obey (D) and second term Democrat Steve Kagen.

The Democrats are losing rural voters who are deeply concerned about the economy and didn’t see any added benefits after the stimulus and Obamacare.

Voters in rural Ohio districts like the eastern-most districts of Reps. Zack Space (D) and Charlie Wilson (D) may be poised to boot out the incumbents. The same is true of swing districts in Ohio like that of northeast Ohio’s John Boccieri  and central Ohio’s Mary Jo Kilroy, first-term Democrats who rubber-stamped the entire Obama agenda. Suburban districts represented by Steve Driehaus (D) and Betty Sutton (D), which are centered around Akron and Cincinatti, are also in play.

Both the North and South Dakota At Large seats are up for grabs for the first time in many years, too. All told, the entire region is in play — from Skelton’s seat in central Missouri to Wilson’s seat in eastern Ohio and from Kagen’s seat in northeast Wisconsin all the way westward to the Dakotas.

A recent Rasmussen poll showed that voters are angry with Members of Congress who voted for Obamacare, the auto bailout, or the stimulus package. By significant margins, voters do not want to reelect incumbents who voted for these unpopular parts of the Obama agenda.

The Midwest’s economy is suffering and people are out of work. Jobs is the main topic of most Congressional debates in the region. Midwest voters are likely to make significant changes in who represents them in Congress. Whether those changes will help the struggling economy recover and foster job creation in the region remains to be seen.

But one thing is for sure: the Democrats have a Midwestern sized problem.

The Caucus Statement of Principles outlines that members support medical and banking privacy, equal protection under the law, and all voluntary and non-violent consensual conduct. Accordingly, the Caucus wishes to praise certain Congressional candidates who have taken exceptional positions on privacy, civil liberties, and equal rights.

“We must drastically limit the ability of government to collect and store data regarding citizens’ personal matters,” says RLC-endorsed Congressional candidate Delia Lopez (pictured, right) of Oregon. Lopez opposes GPS tracking mandates and any move toward a national ID card.

Military veteran David Ratowitz, a RLC-endorsed candidate for Congress in suburban Chicago, says he is “confident that American security is better served by streamlining our military [and] concentrating our forces and avoiding futile nation building.” Continues Ratowitz, “We must recognize that our most powerful tool of foreign policy is the soft power generated by American citizens through their generosity, industry and the example they set for the world.”

“I believe the military should adopt an inclusive approach towards gays and lesbians,” says RLC-endorsed Congressional candidate Joel Pollak of Illinois. RLC Advisory Board member Gary Johnson, the former Governor of New Mexico, recently said “‘Don’t Ask, Don’t Tell’ has always been wrong and it is still wrong.” And earlier this year, the Texas chapter of the Republican Liberty Caucus blasted homophobic language that was added to the official Texas Republican Party platform.

According to the late Senator Barry Goldwater, a hero to many RLC members, “You don’t need to be straight to fight and die for your country… you just need to shoot straight.” Goldwater rightly stated that a fundamental tenet of conservatism is that government should stay out of people’s private lives — and out of the impossible task of legislating morality.

According to National RLC Chairman Dave Nalle, “We are proud that our slate of candidates are speaking on these important social issues and bucking the trend of the Republican Establishment by simply being honest about these issues. Ultimately, these issues — civil liberties and treatment of gay Americans — are about individual rights and freedoms. We’re working for a Republican Party that will defend those rights and freedoms.”

While Morris’ candidates may have a good chance of winning, they are mostly not the kinds of candidates who will move the GOP in a positive direction or take roles as principled leaders in Congress. They may end up being helpful votes as part of a future coalition, but they are not the right candidates to form the nucleus of a new and better Republican majority.

It’s much more important in this key election to put your money and support behind GOP candidates who are both able to win and also dedicated to Constitutional principles and restoring the core ideals of the GOP. To redo Morris’ work from the perspective of a pro-liberty activist rather than a political hack who used to call his pal Bill Clinton while he was in bed with a hooker and Clinton was playing hide the cigar with an intern, I offer my list of the ten house candidates who really deserve your help and your money. They are listed in order of my somewhat subjective assessment of their need and worthiness.

Mick Mulvaney (SC-5)

A principled constitutional conservative who is running in a tough blue-leaning district against an incumbent he has done the near impossible to come up tied at 46% to 46% with his opponent in the latest poll. He needs any support he can get in a critical race.

Trailing in the polls, but working very hard to catch up. He’s a committed Liberty Republican and is trailing 7 points in the polls. It’s a deficit he can make up by November. He has the energy and needs your support.

A principled constitutional conservative who is leading by about 4 points in the latest poll. He needs to widen his lead to secure an important upset win.

One of the most high profile Liberty Republican candidates in one of the most challenging races in the country, taking on Speaker Nancy Pelosi in San Francisco. A strong fiscal conservative with integrity and a background as a navy pilot. The kind of principled leader we need in Congress. Not much polling information, but his fundraising is strong and he seems like a potential winner.

A strong Liberty Republican in a race that is under the radar in northern California. The incumbent was elected in a special election and did not beat Clift by wide margins in that race, so there is potential for an upset with your help.

B. J. Lawson (NC-4)

One of the most respected Liberty Republican candidates, he has surprised many by taking a small lead in the latest poll. He needs to widen that lead to secure the seat and put another principled spokesman for liberty in the House.

Lee Byberg (MN-7)

Coming off a very strong primary win, but the race hasn’t gotten much media attention. Internal polling suggests that he can win with enough support and exposure. He’s a strong constitutional conservative with civil libertarian leanings.

These are hardly the only deserving candidates, but Morris picked ten so I limited myself to that. I eliminated great candidates with races which were too hard to assess like Bill Gunn (MA-1), Dan Sebring (WI-4) and others. I also passed over candidates who are running away with their races like Justin Amash (MI-3) or some who just seem too far behind to be saved.

There will be many turnovers in the House this fall.  There’s not one candidate Morris and I agree on, but there’s room for his less inspiring candidates if we can put my 10 pro-liberty, pro-constitution Republicans in the House to show them the way.

Not only is Minnesota RLC member Norann Dillon running for State Senate, but many RLC members were among the first to rally behind State Rep. Tom Emmer, one of two potential Republican Gubernatorial nominees. Polls show Emmer defeating his Democrat opponents.

The Michigan RLC recently held a successful Convention with former New Mexico Governor Gary Johnson. The Nebraska RLC is holding its Convention with Governor Johnson in July. The Illinois RLC recently endorsed several candidates.

Additionally, the Wisconsin RLC and C4L chapters are planning to reach out at the state GOP Convention in late May. Meanwhile, Indiana and Ohio have primaries quickly approaching. The Indiana chapter is working to endorse candidates and Ohio RLC members are working to charter their chapter.

Activists in the Midwest are doing good work to keep liberty alive.

In November Ratowitz stands a good chance of beating big government Democrat incumbent Mike Quigley in a district which is mostly middle class Chicago suburbs and leans Democrat, but was held by a Republican during the mid 1990s.

Ratowitz commented after the final results were announced, as he and supporters celebrated at Wise Fools Pub in Chicago:

“My campaign was consistent, informed and relentless in its delivery of a limited government and free market message to the people of Congressional District 5. Ultimately, the voters – both in the city and the suburbs – roundly accepted that message as their own.

“I stand with the independent businesses and working families of the 5th Congressional District who are insisting, in no uncertain terms, on a far less intrusive federal government and increased fiscal responsibility at all levels. This victory is a decisive win for liberty, the first of many that will propel our campaign to success in November.

“I thank my family, supporters, staff and, most assuredly, my fellow citizens of Illinois District 5.”

The RLC looks forward to supporting Ratowitz through the general election and in bringing the liberty message to Washington DC after he wins in November.

Unlike each of his opponents, Andrzejewski is a common citizen — a father and businessman rather than a career politician.

The Illinois primary is today, ridiculously early, and catches us all off guard.

Illinois politics is unique, to be sure. It’s filled with a corrupt cesspool of self-aggrandizing politicians — in the Rod Blagojevich mold — each hoping to out-power one another to become king of the citizenry. It’s power politics, to be sure, and is filled with name-calling, manipulation, and maneuvering.

Adam Andrzejewski is a rare political outsider with common sense and commitment to limited and transparent government.  All of this is rare in Illinois politics, which is usually filled with special interest candidates or those with a solid family tree of political history.

Whatsmore, Adam is gaining traction and could be the GOP nominee for Governor.

As the Republican Liberty Caucus choice for Governor, we hope Illinois voters see in Adam what Rush Limbaugh and former president of Poland Lech Walesa see; both endorsed his candidacy in the last week.

In addition to being profiled at the popular conservative blog RedState, Adam was recently featured in Politico article and at National Review online.

Depending on what poll you believe, Adam is either in first or second place in the tough primary field.

Will the Tea Party impact today’s Illinois GOP gubernatorial race? If so, Adam will be the Republican nominee.  Illinois will be a better place if that happens.

According to Illinois RLC Vice-Chair John Bambenek, after thorough research into all the candidates, Adam Andrzejewski had the best credentials to reform state government, bring jobs back to Illinois and resolve the lingering budget crisis.

Responding to the endorsement, Andrzejewski said, “The mission of the Republican Liberty Caucus is to serve as the conscience of the Republican Party. David Ratowitz was also endorsed by the RLC.  He is running for Congress to restore freedom to the Fifth Congressional district and has also been endorsed by Cook County Commissioner Tony Peraica and the political arm of the National Taxpayers United of Illinois. In addition, Ratowitz has been featured on Judge Andrew Napolitano’s “Freedom Watch” program on FOX News several times.

Bruno Behrend, RLC Chairman, said last week on Chicago talk radio, “If the Republican Party nationally had listened to the members of the Republican Liberty Caucus, they would not have lost their majorities in 2006 and 2008.”

He’s right.

And if Illinois voters listen to the Illinois RLC in 2010, they will be well on their way to reforming state government by electing Andrzejewski Governor, sending Ratowitz to Congress, and passing the Putback Amendment.
