BANGOR (March 16, 2011) – A resolution submitted by state Rep. Richard Cebra, R-Naples, which would reassert states’ rights and nullify unconstitutional federal mandates has been unanimously endorsed by the Maine Republican Liberty Caucus (RLC).

“The Constitution clearly enumerates the legitimate powers of the federal government through the Tenth Amendment,” explained Maine RLC Chair Ken Lindell of Bangor, a former member of the Maine House. “What Representative Cebra’s resolution accomplished is to put the federal government on notice that its powers come from the states and individual citizens and it must stop arbitrarily handing down unconstitutional mandates which conflict with the rights of states and individuals.”

Lindell said the issue is non-partisan because federal-state jurisdiction crosses party lines. He noted several instances of federal actions which impacted individual rights such as the Real I.D. mandate which came from a Republican administration in Washington but which a Democrat gubernatorial administration fought on behalf of Maine individuals.

“Putting partisan considerations aside, as a Republican I think the Bush Administration acted improperly on Real I.D. and Governor Baldacci and then-Secretary of State Matt Dunlap acted properly in standing up for the rights of Maine citizens rather than bow to the constitutionally-questionable federal mandate,” Lindell explained. “The issue isn’t Republican or Democrat but limited government versus bigger government and personal liberty.”

Lindell noted that new federal dictates on selling agricultural products such as raw milk would infringe on the rights of organic farmers, who are an important segment of Maine’s agricultural community. He said the U.S.D.A., F.D.A. and other agencies issue directives without regard for the rights of individual farmers and, often, with dubious constitutional authority.

The federal government’s unwillingness to honor state-enacted medical marijuana laws and its zeal to enforce the 1970 Controlled Substances Act is another example of the constitutional breach, Lindell said. “The people of the State of Maine voted legally under powers granted by the United States Constitution to allow individuals with specified conditions to possess and use limited quantities of medicinal marijuana with a prescription, however the federal government shows no signs of pulling back on rigid enforcement which would make those operating legally within state laws criminals in federal courts,” he said.

Lindell said instances abound ranging from gun rights issues to the Affordable Care Act where federal mandates conflict with the Constitution and expand federal power over individual freedom and states’ rights.
“The Tenth Amendment says clearly in 28 words: ‘The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.’ What Rep. Cebra’s resolution does is puts the federal government on notice that Maine people will not be bullied and will nullify those mandates coming from either Congress or Executive Order or from agency rulings which violate constitutional powers,” Lindell said.

Lindell said the issue goes back to the early days of the country. In 1798, Congress passed the Alien and Sedition Acts which so stepped on constitutional freedoms that Thomas Jefferson admitted that he feared “to write what I think.” Newspaper publishers were convicted under the Sedition Act if their papers even carried columns critical of Congress or the president.

“Jefferson relied on the doctrine of nullification to protect First Amendment rights and to restore powers where they constitutionally belonged. Our Republican Liberty Caucus board is taking a stand on this resolution because we see 21st Century parallels which must be addressed to protect the rights of states and, above all, individual freedom and liberty,” Lindell said. Cebra’s resolution is similar to ones adopted by five other states and under consideration in the legislatures of 16 other states.

The Republican Liberty Caucus is a national organization which represents the limited government, individual liberty wing of the Republican Party. The RLC supports individual rights, limited government and free enterprise. The Maine RLC Chapter is independent of the Republican State Committee so it can endorse candidates in primary elections and take positions on legislation.

Maine Legislature Tackles Right to Work, Relaxed Seatbelt Law

A showdown is brewing at the Statehouse between Rrepublican lawmakers and organized labor as two different Right to Work bills have been proposed by the Republican legislature.

LD 788 and LD 309 are both aimed at blocking unions from requiring non-members to pay fees to the union for negotiating their pay and benefits. State government added those fees, called “fair share,” under former Governor John Baldacci (D).

One bill would ban the fair share or similar fees for public sector workers, while a second bill would prohibit similar fees for union workers at private companies. Union members say the bills are really aimed at “busting” unions, and accuse Governor LePage and private corporations of pushing the right to work agenda.

At a press conference in Augusta, union members claimed passage of the bills will hurt Maine workers by eventually forcing down wages and reducing benefits to union and non-union people alike. But RLC-endorsed Rep. Richard Cebra, a co-sponsor of both bills, sees it very differently. Cebra says the top ten states with the strongest economies are all Right to Work states, and that the ten states with the poorest economies are non-Right to Work states. Cebra says he does not know how much support there is for the bills in the Legislature, but that with a Republican legislature and governor, this is the time to bring the issue up.

This bills are expected to come up for public hearing in May.

The Maine Senate passed a bill reducing seatbelt law enforcement to a secondary offense last week. If passed and signed by Governor LePage, the law would mean a violator could not be given a ticket unless stopped for another offense. The bill still faces further House and Senate votes.

Under present law, all motorists in Maine must wear a safety belt and can be fined $50 for the first offense and $125 for the second offense. Republican Governor Paul LePage supports both right to work and the Republican-backed seatbelt proposal.

Let’s hope nullification, Right to Work, and the seatbelt bill each pass the legislature and are signed into law!

The meeting was on neutral ground in a hotel conference room in Augusta. Ten of us sat around a rectangular table with Senator Snowe and two aides at the head of the table. The common thread was that all the participants represented factions of the Republican Party that were either critical of Senator Snowe’s moderate track record, and in some cases outright hostile to the Senator. The meeting was clearly an effort to reach out to the “right wing” (although, as a libertarian, I reject that label) of the Republican Party.

Senator Snowe began the meeting by thanking us for attending and stating that she wanted to have an open and frank discussion of issues facing the country as well as hearing criticism of her own voting record in the U.S. Senate.

Wow! That was certainly a bold thing for her to do given the ideological demographic of the room. What followed was a very civil yet frank discussion of the big issues facing the country. Olympia Snowe is one of the most seasoned and skillful politicians in the country. Her skills shone as she defended her record. She spoke extensively about some of the truly beneficial work she has done for the State of Maine: saving the Domtar paper mill in eastern Maine, saving the Kittery naval shipyard and consistently working to bring Federal funds to the state. There is no doubt that a good deal of her political success can be attributed to her excellent constituent service work.

Senator Snowe ably defended her voting record on health care. Some in the room thought that her support in committee for Obamacare was a decisive vote. In fact it wasn’t, and she made that clear. She explained that she had voted for the bill in committee in exchange for a promise from Senate Majority Leader Harry Reid that the legislation would be open to Republican amendments when it reached the Senate floor. Reid broke his promise, she said. Snowe insisted that she is not only opposed to Obamacare now, but that she supports full repeal of the law. A recent vote of hers has actually borne that promise out.

At one point in the meeting when Snowe was accused of “voting against Republicans” we saw her become somewhat emotional. She recounted the time when her husband John “Jock” McKernan was the Governor of Maine. He was in the midst of a government shutdown resulting from a standoff with the legislature over workers’ compensation reform in the late 80′s. Then-Congresswoman Olympia Snowe was on the phone with her husband and she could overhear shouts and insults from protesting State employees who had been admitted to the state house by then-Speaker John Martin. Snowe commented that she and Jock felt that they were not supported by many Republicans at the time.

Olympia Snowe also defended her vote for TARP (the 2008 financial bailout bill) arguing that the country was at the edge of an abyss. She went on to announce that she would be sponsoring a constitutional amendment to require a balanced budget as well as a higher threshold (3/5 vote) to raise taxes. The balanced budget amendment sat well with the invitees in the room.

What fell flat, in my opinion, were some of her answers to questions that should have been predicted from that crowd. Snowe seemed puzzled by a suggestion that the recent food safety bill was unconstitutional because it affected farmers who don’t sell their produce across state lines. Snowe even boasted that she was able to include a provision that farmers with revenues of less than $500,000 would be excluded. What about the potato farmer who brings in $500,001, but doesn’t ship one French fry outside of Maine?

Some in the room questioned the Senator’s membership of the Council on Foreign Relations and even asked if she supported George H. W. Bush’s reference to a “New World Order”. At that point we were getting into some really esoteric conspiracy theory territory. Nevertheless one would expect the Senator to at least understand the context of the comments and be able to respond appropriately. It really seemed to me that she was flummoxed (although she might have been just carefully considering the question). In fact I found myself in the awkward position of having to explain the issue. I also made clear my view that while there is a real threat to our constitution from those who would undermine US sovereignty with globalism, that wasn’t what Bush 41 was referring to in 1991. I would think that someone on her staff would have briefed her about this stuff before going into a meeting that included devotees of the John Birch society.

The genesis of this meeting was clearly a concern by Olympia Snowe’s political operation that she may be facing a primary challenge (we now know that she is) to her upcoming reelection effort in 2012. Snowe has long been seen as a thorn in the side of the “right wing” (again, as a libertarian I exclude myself from that label) of the party. It would be one thing if she were simply a social moderate and a fiscal conservative. That would certainly be okay with me and other libertarians. Her real problem lately has been on the fiscal conservative side of things. I refer specifically to the elephant in the room. The elephant that was never acknowledged at this meeting. That is the Obama stimulus bill. The gigantic budget-busting $800 billion attempt to stimulate the economy in early 2009. Senator Snowe was instrumental in the passage of that bill. The Tea Party movement was a direct reaction to the Stimulus bill, Obamacare just threw fuel on the fire.

Over her career, Olympia Snowe has certainly been a moderate, but a moderate with a libertarian angle. Every year the Republican Liberty Caucus ranks members of Congress on the Nolan chart-inspired Liberty Index. The Liberty Index ranks members of Congress on a pro-liberty voting index equally weighted between social issues and economic issues. Sen. Snowe has consistently scored above 50% on both axis. In fact, most recently she scores in the conservative quadrant with a better record on economic issues than social issues. That record has always earned Olympia Snowe support from me in her previous election campaigns. The question I struggle with now is whether her vote for stimulus was a deal breaker in the next campaign.

I wanted to keep RLC membership informed of this development. We should certainly make time to discuss it during our upcoming Maine RLC Leadership Conference — which is scheduled for April 23, 2011 in Augusta, Maine.

Earlier this week, Traci Gauthier, secretary of the Republican Liberty Caucus of Maine, took a big step up in her state party, winning election as Chair of the Penobscot County Republican Committee for a term through January 2013.

Gauthier was a founder of the Lincoln area Republican Club, which organized more than a dozen small towns into a grassroots organization to work for local GOP candidates. She also ran for State Senate in 2010 in Maine State Senate District 30 and has been serving as State Committeewoman for her county. As County Chair she will continue to serve on the State Executive Committee and her position as a State Committeewoman will be filled in a special election.

Gauthier has a strong commitment to grassroots activism. “I want to reorganize so that all parts of our huge county have equal representation and see that every community has a Town Chair so that we can assist their local candidates with a strong grassroots organization to continue party progress,” Gauthier said.

The Republican Liberty Caucus of Maine has had a very successful year, electing five State Representatives and two State Senators. Several members of the Maine RLC will be attending the upcoming RLC National Convention in Arlington, VA on February 12th.

Jamie Callender is an attorney, college professor, and former State Representative who served in the Ohio House from 1997 to 2004. He represented a Democratic area despite being a Republican with a strong libertarian streak. With his leadership, Ohio was able to greatly expand school choice — an issue he is very passionate about. He was term limited out of office. Callender currently serves as a Professor of Public Policy at Kent State University. He and his family live in Lake County, Ohio in the Cleveland metropolitan area.

R. Kenneth Lindell is a former one-term Maine State Representative. In addition to serving as the Chairman of the Republican Liberty Caucus of Maine, Ken was also Chairman of the Ron Paul for President campaign in Maine. Ken is also a Certified Financial Planner. He and his wife Althea, along with their three children, reside in Frankfurt, Maine. He has been a longtime advocate of the liberty message and also attended the 2006 RLC National Convention in Orlando, Florida.

Don Murphy is a former elected Delegate from Baltimore County, Maryland. He was first elected in 1993 and served until 2002. He is a co-founder of the Patapsco Valley Republican Club, served as Chairman of the Baltimore County Republican Party, and served as a Delegate to the Republican National Convention. In 2010, he was a Senior Advisor to RLC-endorsed Senate candidate Dr. Eric Wargotz. Don is also the founder of Republicans for Compassionate Access, a group of Republican legislators who believe in a patient’s right to choose medical treatment under a doctor’s care. Delegate Murphy has attended every RLC National Convention since 2006.

Terri McCormick is Vice Chair of the Republican Liberty Caucus of Wisconsin and is a former three-term State Representative who represented Appleton and Neenah. She is also a two-time candidate for Congress. Terri pioneered one of the first state charter school laws in the country and formed the Wisconsin Charter School Association. She is an advocate of term limits and upheld her term limits pledge. Legislation she authored expanded small business growth in the state of Wisconsin and also created a prescription drug purchasing pool for seniors. Terri is the author of the book, “What Sex Is a Republican? Stories from the Front Lines of American Politics and How You Can Change the Way Things Are.”

Dr. Rand Paul is Senator-elect from Kentucky. Justin Amash (pictured, right) is Representative-elect from Michigan’s Third Congressional District. Congratulations, Rand and Justin! RLC supporters have no doubt that these two champions of liberty will work vigorously to promote our vision of a free country in Congress.

The RLC is also pleased that Mick Mulvaney of South Carolina, John Koster of Washington state, Chip Cravaack of Minnesota, and Steve Chabot of Ohio will join Dr. Ron Paul and our other pro-liberty Republican legislators in the U.S. House of Representatives.

Joining Rand Paul in the Senate are RLC-endorsed Senate candidates Mike Lee of Utah and Pat Toomey of Pennsylvania.

Two RLC-endorsed candidates for Governor, Paul LePage of Maine and Nikki Haley of South Carolina, were elected. LePage and Haley come from very different backgrounds and from different parts of the country, but are united in their strong belief in the individual and faith in the free market system.

Other key RLC victories and races we are still watching are below.

Arkansas: State Rep. Mark Martin, a RLC endorsed candidate, won his bid for Secretary of State. He is the first statewide Republican elected official since former Gov. Mike Huckabee left office.

California: Despite losing on the RLC-endorsed Proposition 19 to legalize marijuana in California, the RLC’s positions on Prop. 27 (no to eliminate the state redistricting commission) and Prop. 21 (a vehicle license surcharge to fund state parks) were adopted. Additionally, the RLC’s positions on Prop. 20 and 26 were adopted. These propositions related to Congressional redistricting and the process to impose state/local fees. Arizona: 55 percent of state voters supported an amendment to the state constitution disallowing the Obamacare individual mandate to take effect in Arizona. Voters also approved medical marijuana.

Colorado: Despite Ken Buck’s Senate loss, RLC-endorsed candidate Donald Beezley defeated an incumbent and is now an elected State Representative from Broomfield.

Idaho: RLC-endorsed candidate for Bonner County Commissioner in District 2, Mike Nielson, won election on a platform of transparency and balanced budgets. Nielsen said he was eager to start getting more detailed budget information on the county website and wants to get a head start on the 2012 spending plan, according to The Bonner County Daily Bee.

Indiana: Republican Liberty Caucus member Steve Davisson was elected State Representative in Southern Indiana’s 73rd district. Congratulations, Hoosiers!

Kentucky: In addition to Rand Paul’s victory, RLC-backed candidate Thomas Massie was elected Judge Executive in Lewis County.

Maine: In addition to the victory of Paul LePage for Governor, RLC candidates for State Rep. and State Senate also found success. State House Challengers Michael McClellan, Ryan Harmon, Richard Malaby, Beth O’Connor, and Eleanor Espling (pictured, above left) — each endorsed by the Republican Liberty Caucus of Maine — won election. Additionally, former State Senator Lois Snowe-Mello won her old seat back and State Rep. Doug Thomas was elected to the State Senate. The RLC had a great day in Maine yesterday!

Maryland: Cindy Jones, a RLC member and delegate at our 2009 Convention in Florida, was elected to the St. Marys County Commission. Among all of the county commissioner races, Mrs. Jones had the largest margin of victory and the highest vote total. Four of the five Commission seats are now held by Republicans.

Michigan: RLC-endorsed candidate for State Senate Arlen Meekhof was elected to the post. Meekhof wants to repeal the Michigan Business Tax surcharge and bring jobs to the state.

Minnesota: Despite losing the Governors race narrowly, the RLC had its coalition of candidates elected to the State Senate and the State House. Kathy Lohmer (pictured, right), Andrea Kieffer, Doug Wardlow, Kurt Bills, and Sondra Erickson were elected to the House and Dave Brown and Dave Thompson were elected to the Senate. Former Minnesota RLC Secretary Norann Dillon narrowly lost in her race against an incumbent in a Democrat district. Congratulations to these new legislators and to the Minnesota RLC!

Missouri: In The Show Me State, RLC-endorsed candidate Paul Curtman was elected State Representative. He will represent parts of Jefferson, Franklin and St. Louis counties. Additionally, RLC-endorsed candidate Brian Nieves was elected to the State Senate. Two RLC-endorsed incumbent State Representatives, Tim Jones and Shane Schoeller, will be taking over leadership positions in the Missouri House of Representatives. The Missouri RLC is hosting its 2010 Convention on Saturday, November 13 in Springfield.

Montana: In Montana the RLC has an incumbent coalition in the State House and the entire slate of RLC-backed candidates was reelected. Additionally, former State Senator and longtime liberty advocate Jerry O’Neill was elected to the House of Representatives.

New Hampshire: Former Republican Liberty Caucus of New Hampshire Chair Jim Forsythe was elected to the State Senate and State Rep. candidates Cameron DeJong and Andrew Manuse were elected to the State House. RLC Board member Paul Mirski was elected to the State House in Grafton as was former RLC Chair Dan McGuire in Merrimack. Longtime liberty activists Keith Murphy and Seth Cohn won election to the State House from Hillsborough and Merrimack, too. A full list of RLC victories from New Hampshire can be found here.

North Carolina: Republican Liberty Caucus-endorsed candidate Glen Bradley won election to the State House of Representatives. Congratulations to Glen and the North Carolina RLC!

Oklahoma: 65 percent of voters supported a ballot proposition to rebuke Obamacare by not allowing the individual mandate contained in the health care law to be enacted in the Sooner State.

South Carolina: RLC-backed candidate Curtis Loftis, who ousted the incumbent State Treasurer earlier this year in the primary, is now the State Treasurer-elect of The Palmetto State.

Uah: Two new RLC-endorsed candidates won election in Utah — Daniel Thatcher was elected to the State Senate and Ken Ivory won election to the State House. Ivory joins several other RLC incumbents in the House.

Texas: The Texas RLC helped elect two new State Representatives, Jason Isaac and David Simpson. Additionally, former Texas RLC Chairman Melissa Goodwin was elected Justice on the Third Court of Appeals. RLC Advisory Board member Jerry Patterson was re-elected State Land Commissioner. Wisconsin: In Wisconsin, a coalition of RLC-backed candidates for State House have won election for the first time. The slate includes: Andre Jacque from Green Bay, Jim Steineke from Appleton, Chris Kapenga from Delafield, Evan Wynn of Whitewater, Scott Krug of Black River Falls, Jeremy Thiesfeldt of Fond du Lac, and Roger Rivard of Rice Lake. Mr. Krug beat incumbent Marlin Schneider, who served in the legislature continuously since 1970. Congratulations to the Wisconsin RLC and Badger State voters!

Wyoming: Endorsed State Representative candidate Gerald Gay won election to the legislature for the first time.

These election results show not only the strength of the Tea Party, but also the disgust of average Americans with unresponsive, anti-liberty bureaucrats. The results also illustrate that liberty principles are popular and will make a comeback!

The battle has just begun, so thanks to all of our activists and candidates from across the country. Thanks especially to the state and national officers of the RLC who allow our organization to function.

The Republican Liberty Caucus is a grassroots coalition of liberty-loving Americans.

While Morris’ candidates may have a good chance of winning, they are mostly not the kinds of candidates who will move the GOP in a positive direction or take roles as principled leaders in Congress. They may end up being helpful votes as part of a future coalition, but they are not the right candidates to form the nucleus of a new and better Republican majority.

It’s much more important in this key election to put your money and support behind GOP candidates who are both able to win and also dedicated to Constitutional principles and restoring the core ideals of the GOP. To redo Morris’ work from the perspective of a pro-liberty activist rather than a political hack who used to call his pal Bill Clinton while he was in bed with a hooker and Clinton was playing hide the cigar with an intern, I offer my list of the ten house candidates who really deserve your help and your money. They are listed in order of my somewhat subjective assessment of their need and worthiness.

Mick Mulvaney (SC-5)

A principled constitutional conservative who is running in a tough blue-leaning district against an incumbent he has done the near impossible to come up tied at 46% to 46% with his opponent in the latest poll. He needs any support he can get in a critical race.

Delia Lopez (OR-3)

A promising and hard working Liberty Republican who speaks out strongly for Constitutionally protected rights and civil liberties. She’s a real anti-establishment candidate who is running a very active campaign, but has an uphill battle.

David Ratowitz (IL-5)

One of my favorite Liberty Republicans running this year. On the right side of just about every issue. Strong on individual liberty and fiscal issues. He has a tough but winnable race, but needs help to pull off an upset.

John Dennis (CA-8)

One of the most high profile Liberty Republican candidates in one of the most challenging races in the country, taking on Speaker Nancy Pelosi in San Francisco. Yes, he’s down by more than 20 points in the polls, but there are still enough undecided votes that he could win. He might be able to pull off a miracle with your help.

Chip Cravaack (MN-8)

A strong fiscal conservative with integrity and a background as a navy pilot. The kind of principled leader we need in Congress. Not much polling information, but his fundraising is strong and he seems like a potential winner.

Gary Clift (CA-10)

A strong Liberty Republican in a race that is under the radar in northern California. The incumbent was elected in a special election and did not beat Clift by wide margins in that race, so there is potential for an upset with your help.

B. J. Lawson (NC-4)

One of the most respected Liberty Republican candidates, he has surprised many by taking a small lead in the latest poll. He needs to widen that lead to secure the seat and put another principled spokesman for liberty in the House.

Lee Byberg (MN-7)

Coming off a very strong primary win, but the race hasn’t gotten much media attention. Internal polling suggests that he can win with enough support and exposure. He’s a strong constitutional conservative with civil libertarian leanings.

These are hardly the only deserving candidates, but Morris picked ten so I limited myself to that. I eliminated great candidates with races which were too hard to assess like Bill Gunn (MA-1), Dan Sebring (WI-4) and others. I also passed over candidates who are running away with their races like Justin Amash (MI-3) or some who just seem too far behind to be saved.

There will be many turnovers in the House this fall.  There’s not one candidate Morris and I agree on, but there’s room for his less inspiring candidates if we can put my 10 pro-liberty, pro-constitution Republicans in the House to show them the way.

District of Columbia: DC Republican City Council candidates Jim DeMartino (Ward 6) and Tim Day (Ward (5) will present and answer questions at the RLC-DC meeting on Monday, August 30, along with Ward 1 School Board candidate Patrick Mara. Florida: The Florida RLC will have an outreach table, make a short presentation about the RLC and hold an informal RLC update and discussion get-together in conjunction with the Campaign for Liberty’s Summit at the Rosen Centre in Orlando. The informal RLC statewide meeting will be held at 12:30-1:30 pm on Saturday, August 12 at the RLC outreach booth at the Summit. Indiana: The state RLC affiliate will hold its Convention at George’s Neighborhood Grill (6935 Lake Plaza Dr) in Indianapolis on Saturday, September 25. The keynote speaker will be Attorney General Greg Zoeller. RSVP on Facebook.
