Special Action Alert to Oppose Military Detention of US Citizens

Last week we were part of an epic struggle led by Senator Rand Paul (RLC-KY) to block the inclusion of language in the National Defense Authorization Act (NDAA) which would make it legal for US Military forces to operate inside the US in violation of Posse Comitatus and arrest US civilians and hold them in military detention without charges for an indefinite period of time in violation of the right of Habeas Corpus, a fundamental legal protection under the Bill of Rights. Granting these extraordinary powers to the military is obviously unconstitutional and is opposed by the Federal Bureau of Investigation and other law enforcement agencies.
Efforts to remove indefinite military detention from the NDAA were blocked by establishment leaders from both parties in the Senate, though Senator Paul did lead a last minute effort to successfully defeat an unexpected additional amendment which would have given the government even more extensive powers to arrest and hold citizens without charges.

The original problem sections (1031 and 1032) are still in the bill and contrary to the claims of supporters of the bill, the wording of section 1032 does not, in fact, provide protection for US citizens. The use of the phrase “not required” instead of “prohibited” leaves the decision to allow the military to detain citizens entirely in the hands of federal authorities.
The only remaining opportunity to have these sections removed from the bill will be during the coming week in the reconcilliation process where members of both houses in a conference committee negotiate a final version of the bill. During this process all members of Congress can make recommendations for changes or adjustments in the language and if there is enough outcry it’s possible that the joint committee will do the right thing. Reconcilliation will be wrapping up in the next few days so a final push on this issue on Monday the 12th is absolutely essential.
This will be our last chance to fix the bill and protect our liberties short of hoping for an increasingly unlikely veto from President Obama. Even if you previously wrote in during our effort to stop the bill in the Senate, please take this opportunity to write both your Represenative and Senators using the form below to ask them to speak up against the inclusion of indefinite military detention in the bill. The provision in the NDAA to indefinitely detain American Citizens under military detention is a usurption and total violation of the 4th, 5th and 6th Amendments under the U.S. Constitution. Under the the 5th Amendment it is a deprivation of life and liberty and the allowance of Due Process.

PLEASE VOTE AGAINST THIS!!! If the DC Clowns don’t want to uphold their oaths and observe the law, then how can they expect us to? I will not comply will unlawful orders. I will not submit to tyranny. What would Thomas Jefferson do? Look at Ron Paul and you’ll know. This is more the reason we need to pour all our support into the only honest man running in this race..

When someone brings guns into politics it’s like discussing something taboo. But I have to say I have participated in the spike of gun sales this year. Also, all I want for christmas is more. To be clear, I don’t plan on attacking or hurting any one but knowing I have a gun for all my friends that do not, makes me feel safe. This bill is destructive, and absurd. China knows never to invade the US because as they have said before, “behind every blade of grass will be an armed American.” The US needs not threaten their own people, especially if they are planning conflicts with possible invaders. Who will save the US. Not the military alone. It will be mixed with the free people.

Since 1865. Pragmatism gets results and many would accept that. I think that it is only principles that make results worthwhile and our government stopped acting on principle in the 1800′s.

to make and there is no time left to ponder the options, there are only
two. Do you support the United States
Constitution, Honor and morality or do you side with the immorality, dishonor
and tyranny of those who seek to destroy the Constitution.
Like it or not our nation is dividing on these two principles. I call
it the new dual society of the East vs. the West. The East is represented by Liberals,
Progressives, Socialists and the current Administration. Individuals aligned with the East consists of
those who have never had to sacrifice, struggle, or work for anything in their entire
lives. These are people who were either
born into wealth or have lived off the labors of others from birth. Their alliance includes individuals hell-bent
on the destruction of Freedom, Liberty or any notion of individual rights and
responsibilities. These are historically
the enemies of our great republic. For
the most part the East is governed by the Democrat Party. This is not the Democrat party of the
past. The old Democrat party is buried
in history, though many Democrats have yet to understand this fact. Many current Democrat legislators are
dismayed by what has happened to their party.
If this is the direction you decide on you must realize there is no
loyalty, Compassion, Honor or morality here.
You, as an individual, do not exist and your needs are of no consequence,
you will do as you are told or be pushed aside for those who obey the elite.
The West is represented by conservatives. This one group of patriotic, Loyal,
Compassionate, God Fearing and Moral
individuals have been the mainstay of Freedom and Liberty in America from its
beginning. There would be no United
States of America if not for the backbone Conservatives. The United States Constitution is the
Conservative’s Manifesto. No other group
can attempt to claim that they represent our Constitution it is an absolute
right of the Conservative American. To
be a Conservative one must reject racism,
bigotry, immorality and any inequality based on natural human traits. To be a Conservative one must embrace the
idea that all men are created equal and are guaranteed the absolute rights to
life, liberty, and the pursuit of happiness.
This includes any and all provisions made by the Constitution of the
United States of America as our founding fathers intended.
Those who now stand in defiance of the Conservative American
do so in ignorance. They would be well
advised to understand that Conservatives represent the majority in the United
States. They are dedicated to the
preservation, protection and adherence to The United States Constitution as our
founding fathers intended, it is the supreme law of the land. The United States military as well as every
law enforcement agency in our nation are bound by this law and render
themselves illegitimate when in violation of it. Our current administration has become such an illegitimate institution as
a result of its violations of the
Constitution.
Conservative Americans are willing to go to whatever lengths
are necessary to protect our nation, our laws, our freedom and liberty. We are strong willed and determined to
enforce the laws of our Constitution.
I have not mentioned the Republican Party here because it
has not decided which side it wants to be on as of this time. When those in charge of the party finally
decide Conservatives might be willing to listen, so far they have done nothing
to impress any of us.

On December 5, 2011, The Harris County Republican Party, where Houston, Texas is located, took a position opposing Section 1031 of the National Defense Authorization Act (adopted by the Senate 12/1/11) which allows for indefinite detention by the military and law enforcement.

Art, I really like how you outlined this. I was raised a democrat without even realizing it. Was push away from republicans in the Nixon era. Like many others, I believed in the change Obama offered with no other thought. But now I’m registered republican because of Ron Paul showing me the true meaning of one. I’ve always worked for what I needed, just don’t know any other way. I’m well versed in the Constitution, Bill of Rights, everything our founding fathers stood for.
And now like you, I foresee another revolution at hand. I’ve turned all my friends family and customers into “Paulies”. Though I haven’t sought arms yet, that next, I have been preparing for it. Looking for a good place and people to stand with. I figure I’ve developed some good skills along the way and the tools to build pretty much anything I want. I’ve come to realize also that if Ron doesn’t get elected, soon the whole country will be in chaos and we’ll pretty much be survival of the fittest. If he does get elected, I fear someone will be gunning for him and it’s up to true Americans to protect him.
So, thanks Art for the good words and if it comes down to it, I hope it’s people like you standing beside me.

What I don’t understand is, why hasn’t the military taken real action on such a treasonous bill against the Constitution and the servicemen who have gone before? It is shocking that anyone even suggested this monster in the first place, let alone it passing with such a HUGE majority!

Since the 1992 election I realized that most of my fellow citizens have it wrong!
They think the American dream is about a car in every garage and a chicken in every pot. It’s not!
The American Dream is the belief in self-government (a civil society, if you will) and a very limited government for the purpose of defending the rights of the society’s members (the political society).
Until Americans realize there is a tradeoff between freedom and equality, they will vote for those who will greedily gather power unto themselves while claiming to “help the downtrodden”. This has been true of human history and behavior for more than 5 millennia.
Mostly, I do not expect any politician or collection of politicians to deliver utopia in an imperfect world.
